Terms & Conditions

These Terms & Conditions govern all design and creative services provided by Anna Mar Design – Creative Studio (“Designer”, “I”, “me”) to the client (“Client”, “you”). By booking any service, the Client agrees to the following terms.
1. Services Covered
These Terms apply to all services offered by Anna Mar Design – Creative Studio, including but not limited to:
Custom design services (branding, logos, graphic design, marketing materials)
Website design, development, redesign, migration, and support
Video editing, motion graphics, and post-production
Creative consultancy, strategy sessions, and audits
Add-ons, website updates, and maintenance services
2. Payments & Project Start
For all branding, logo, and website packages, the following payment structure applies:
40% deposit required before any work begins
Deposit is non-refundable
Project is scheduled only after deposit is received
Remaining 60% is due upon project completion, before any final files or website transfer is delivered
For add-ons, consulting, video editing, and other services, billing may be:
Per session/hourly
Upon completion
Or as outlined in your project proposal
All payment terms will be clearly stated in the individual Proposal or Service Agreement.
3. Revisions
Design packages include a set number of revision rounds, as stated in the proposal.
Additional revisions beyond the agreed rounds will be billed at the current hourly rate.
4. Client Responsibilities
By working with the Designer, the Client agrees to:
Provide all required content, text, images, and information in a timely manner
Ensure any text, images, logos, or other assets supplied by the Client are owned by the Client or properly licensed
Review drafts and provide clear, consolidated feedback
Respond within reasonable timeframes to avoid project delays
The Designer is not responsible for content accuracy, legal text, or copyright compliance for client-supplied materials.
5. Delays, Non-Communication & Cancellation
If the Client becomes unresponsive (no communication via email or phone) for 180 days after project commencement:
The Designer may cancel the project in writing
All fees for work completed up to that point must be paid by the Client
Any unpaid amount will not exceed 100% of the total project price
All copyrights remain with the Designer until full payment is made
If the Client cancels the project voluntarily:
The 40% deposit is non-refundable
Additional fees may apply for work completed beyond the deposit value
The Designer may cancel a project at any time for inappropriate behavior, unreasonable demands, or breach of terms.
6. Rights & Ownership
Client Rights (After Final Payment)
Upon full payment of all fees:
The Client gains full rights to the final approved designs (logo, brand assets, graphics, etc.)
The Client may reproduce them freely
The Client receives all final deliverables as specified in the proposal
Designer Rights
All concepts, drafts, rejected designs, and working/source files (e.g., Illustrator, Photoshop files, website code, project files) remain the property of the Designer
Source files are not included unless specifically agreed in writing and may incur an additional fee
Website-Specific Ownership
For website projects:
The Client owns the final visual design and content
The Designer retains ownership of custom CSS, markup, layouts, or proprietary techniques used but grants the Client a license to use them for the project only
Portfolio Rights
The Designer reserves the right to:
Showcase the completed work in a portfolio, website, social media, and promotional materials
Display a small, discreet credit link in the footer of the Client’s website (removable upon request)
7. Refund Policy
All deposits are non-refundable
All completed work is non-refundable
No refunds will be issued once design concepts, drafts, videos, or websites have been delivered
No refunds are provided for change of mind or Client delays
Refund exceptions may be made only at the Designer’s sole discretion.
8. Turnaround & Timelines
Project timelines outlined in proposals are estimates and depend on:
The Client providing content on time
Client responsiveness
Scope changes
Delays by the Client automatically delay the project timeline.
Rush fees may apply for expedited work.
9. Revisions, Content & Scope Changes
Any additional requests or changes beyond the original proposal may:
Extend timelines
Incur additional fees
Require a revised proposal
10. Third-Party Tools & Integrations
The Designer is not responsible for:
Third-party platform issues (Squarespace, Wix, Shopify, YouTube, Vimeo, etc.)
Hosting or domain issues
Plugin, email marketing, analytics, or API failures
The Client is responsible for maintaining their own subscriptions.
11. Video Editing & Production Terms
For video editing and motion graphics:
Client must provide clear creative direction or allow the Designer to determine it
Video revisions follow the agreed revision limit
The Designer is not responsible for copyright claims related to client-supplied media
12. Consulting & Creative Strategy Sessions
Consulting sessions are non-refundable and billed at the agreed rate.
Any recommendations given are advisory; the Client is responsible for implementation.
13. Confidentiality
Both parties agree to keep all project materials and communication confidential unless permission is granted.
14. Limitation of Liability
The Designer is not liable for:
Losses, damages, or financial results from the use of delivered designs or websites
Website downtime, hosting issues, security breaches, or third-party failures
Legal issues arising from Client-provided content
Maximum liability is limited to the total project fee paid.
15. Governing Law
These Terms are governed by the laws of British Columbia, Canada.
